A Lawful Development Certificate is a legal document issued by a Local Council which guarantees the legitamcy of a Garden Annexe without the need for full planning permission

However we recommend that, on your behalf, we secure a Lawful Development Certificate for your granny annexe, for your peace of mind; as this legal document - issued by your Local Council - ensures the legitimacy of your annexe.

Assuming that
a) the annexe is to be located in a typical domestic rear garden
b) the annexe is to be used by a close member of the family

then the LDC will normally be issued by the Local Authourity.

The LDC submission we make on your behalf is normally only listed on a Local Authourity’s website, and yellow notices and neighbour letters are not normally distributed.

During the process, we issue full site drawing and technical specification and submit a detailed 18 page document to the local planning department to secure the certificate. The document builds the case for the annexe’s legitimacy through demonstrating the moveability of the annexe through video evidence and structural drawings. This includes the unique hybrid nature of the Garden Annexe and the DAP technology used in it’s construction. (Note: a competitor’s SIPS style annexes do not enjoy the strength to demonstrate moveability and are therefore not applicable for an LDC is most cases). We use current and previous legal precedents to reinforce each case.

We have a 96% success rate in securing an LDC and a 100% success record when we have needed to go to appeal.

However, we can never guarantee that an LDC submission will be successful, so we never take on a project when we aren’t confident that we will secure the document.

Note: If your annexe requirement does not comply with both a) and b) above, then we will endeavour to secure formal planning permission for your annexe.
